Learned Counsel for the JD contended that execution has been stayed vide Order dated 2.12.2015, subject to deposit of entire amount as awarded by the District Forum. He further contended that the JD has deposited amount of Rs.6000/- in Hon'ble State Commission as is apparent from Receipt No.981251 dated 21.12.2015 which is placed on file. Learned Counsel for the JD also stated that Draft of Rs.7000/- was deposited in the Hon'ble State Commission and as such, the JD has deposited total amount of Rs.13,000/- including cost and litigation etc. and as such the execution is liable to be stayed.

The JD has produced evidence on the file to show that amount of Rs.13,000/- has been deposited by the JD. In this case, the District Forum granted Rs.10,000/- to the Complainant as compensation and Rs.3000/- as litigation expenses. None has appeared on behalf of the DH in order to contest the contention of the JD. Therefore, in view of the above discussion, the execution is not maintainable at this stage and same is ordered to be consigned to the records, though the DH is free to revive the execution or file fresh execution after disposal of the appeal by Hon'ble State Commission.
