The case of the complainant is that his brother purchased a computer and its peripheral for the use of the complainant from OP for a sum of Rs.32,890/-. The computer was in fact assembled by OP and the OP assured the complainant that all the parts of the aforesaid computer shall have warranty offered by each company respectively. OP further assured to provide best quality of after sale service during warranty as well as post warranty period. The computer was having a monitor the value of same was Rs.9,700/-. Just after few months of purchase of said monitor, a dot appeared on the screen of the same. As the monitor was under warranty period hence complainant immediately reported it to the OP and ultimately the monitor was handed over to the OP on 10.3.07 for removal of the defect. OP issued the receipt in this regard. OP assured that they will repair the monitor and if it is not possible, the same will be replaced.
It is further stated that thereafter complainant enquired from the OP about the monitor number of times but no satisfactory reply was given. Complainant visited OP several times for collection of aforesaid monitor however on each and every time, he returned back with bare hand and till date the monitor is with the OP. It is stated that it is a clear cut case of deficiency in service on the part of OP. It is prayed that OP be directed to refund an amount of Rs.9,700/- or to give a new LCD monitor of the same value and also to pay Rs.50,000/- towards compensation and Rs.15,000/- towards litigation expenses.
On behalf of OP its proprietor Sh. Jitender Pasricha, appeared on 15.5.08 and sought time to file the reply. Thereafter nobody appeared for OP and accordingly OP was proceeded ex parte on 04.8.08.
We have heard complainant and carefully perused the record.
It is proved from the unchallenged testimony of the complainant that a defective monitor was supplied to him and the monitor was duly handed over to the OP for repair on 10.3.07 but till filing of the complaint, the same was not returned to the complainant after repair nor the same was replaced. It is a clear cut case of deficiency in service on the part of OP.
OP is directed to refund Rs.9,700/- alongwith interest @ 9% p.a. from the date of filing of the complaint. OP is further directed to pay Rs.5,000/- towards compensation and Rs.3,000/- towards litigation expenses.
Let the order be complied with within one month of the receipt thereof. The complaint stands disposed of accordingly.
Copy of order be sent to the parties, free of cost, and thereafter file be consigned to record room.
