Heard ld. counsel for the appellant.

          The instant appeal has been filed against the dismissal order passed by the Ld. District Consumer Forum-I, Lucknow in Complaint Case No.458 of 2010 dated 15.5.2023.

          Counsel for the appellant submits that since counsel represents the opposite parties before the ld. District Consumer Forum-I, Lucknow died during the pendency of the complaint, the complaint could not be attended and has been adjourned on various dates.          However, finally for want of prosecution, the same has been dismissed ex-parte.

          Having heard ld. counsel for the appellant, we find that it is appropriate to provide one opportunity to the parties to place the submissions before the ld. District Consumer Commission which will be decided on merit without giving unnecessary adjournment to either of the parties, if possible within a period of six months, from production of the certified copy of this order before the District Consumer Commission.

          The appeal is finally disposed of.

          The Stenographer is requested to upload this order on the website of this Commission at the earliest.
