Today Sh.Amandeep Singh Sohal, Advocate has appeared on behalf of JD no.2 and has filed a Cheque for Rs.2000/- which has been received by the DH under protest on the ground he wants to file Appeal before Hon'ble State Commission. In the present execution application, the Complainant/DH has himself filed Service Job Sheet dated 28.7.2014. After service, the Camera was returned to the DH on 13.8.2014. In Job Sheet, it is mentioned that “work done AF adjustment and cleaned done Camera working fine”. Counsel for the JD contended that order under execution has been complied with. The JD no.2 was directed to rectify the defect in the Camera, if any free of cost. On the other hand, the DH contended that Camera is still not working properly. The DH has filed the present execution application on 12.5.2015 i.e. after about 9 months of the receiving the Camera as per above said Job Sheet. So in case, if there was still any defect in the Camera then the complainant would not have remained silent for about 9 months after receiving the Camera. However if Subsequently any further defect has arisen in Camera, then it is stated to be still under warranty, the DH is at liberty to approach the JD No.2 or its Service Centre for rectification of defect, if any in his Camera. So at this stage, no further action is called for in the present execution application. File be consigned to the record room.
