Today is fixed for filing show-cause by the complainant. Ld. Advocate for the O.ps. is present. Complainant is absent without any step and did not file show-cause. On repeated calls upto 1.10 p.m. none appears on behalf of complainant. It appears from the case record that since order dated 22/02/2023 complainants are absent without any step.

It also reveals from the case record that O.ps filed one petition dated 22/09/2022 wherein it appears that O.ps. stated that the matter has been settled between the parties and accordingly the O.ps. have already executed one deed of conveyance in respect of suit property in favour of the complainant The instant petition is filed through notarized affidavit.

Accordingly, the instant petition filed by the O.p. on 22/09/2022 be kept with the record.

The complainant is also absent without any step and did not file show-cause on behalf of him. It is now 1.30 p.m. On call none appeared on behalf of this complainant.

Hence, the instant Complaint case No.50/2021 is hereby dismissed for non-compliance of the order of this D.C.D.R.C., Howrah.

Accordingly, It is

ORDERED

That the instant C.C. case no 50/2021 be and this same is dismissed for  non-compliance. No order to cost.
