               The complaint was filed by the complainants U/S 12 of Consumer Protection Act, 1986 alleging deficiency in service on the part of the opposite parties in selling a defective washing machine along with a direction to direct the opposite parties to pay a sum of Rs.20,00,000/- as compensation for the mental agony caused to the complainant due to the deficiency in service on the part of the opposite parties with 12% interest and to pay a sum of Rs.5,000/- towards cost of this proceedings to the complainants. 

Today the matter was adjourned for the complainant and the opposite party’s appearance and for making oral and written arguments or for dismissal.  The complainant was absent on earlier occasion i.e, on 22.07.2022 and today the matter appeared in the caption “for dismissal”. Today also there was no representation for the complainant and his written arguments was also not filed. The matter was passed over twice but no appearance was made by the complainant.  Hence this Commission is of the view that there is no purpose in keeping the matter pending as there was no representation for the complainant. Hence, the complaint is dismissed for non prosecution and no order to cost.

 

This order was pronounced by us in the open Commission on this 27th July 2022.
