                   Ms.Babita, Member has not come present today. Sh.Govind Puri, Adv. for OP1 has suffered a statement that OP1, through OP3 has duly repaired the handset of the complainant free of costs and the handset has been returned to the complainant in satisfactory working condition. The complainant has given an undertaking to the OPs that he is satisfied with the repair of the handset and he will withdraw the present complaint. The photocopy of the undertaking is Mark-A.

                   On the other hand, Sh.Deepak Makhija, Adv. for complainant has suffered a statement that he has received the duly repaired mobile from the OP and does not want to pursue the present complaint. Same be dismissed as withdrawn. But, He reserves his right to file fresh complaint, in case any fault found later on.

                   In view of statement suffered by Ld. counsel for complainant, the present complaint stands dismissed as withdrawn. However, complainant is at liberty to file fresh complaint, in case any fault found in the mobile set of the complainant later on. File be consigned to record room.
