                   Vikram Aryan         Vs      M/s Samsung India

 

 

Present        Shri H.S.Sehrawat, Adv for the complainant.

                   Shri Sandeep Yadav, Adv for the OP-1.

 

                  

                   File taken up today on the application moved on behalf of  complainant.

 

                   Learned counsel for the opposite party No.1 has made a statement that OP-1 is ready to refund 55 % amount of the invoice amount on deposit of old handset along with accessories with the service centre provided that the mobile handset had not fallen in water or broken

                 The counsel for the complainant has also made a statement that he is agreed with the statement made by learned counsel for the opposite party no.1 and in view of the statement made by him, the complaint may be disposed off accordingly.

                       In view of the statement made by the parties, we direct the opposite party No.1 to refund 55 % amount of the Invoice amount within 30 days on deposit of old defective handset along with all accessories with the service centre provided that the handset had not fallen in water or broken. The opposite party No.1 shall make the compliance of the order within 30 days from the date of receipt of the copy of this order.  The complaint stands disposed off accordingly.
