ORDER

By G. Yadunadhan, President: The case of the complainant is that on 5.10.2007, he purchased a mobile phone from the 1st opposite party, of the description Nokia N-70 Music Edition for an amount of Rs.11,000/-. The 1st opposite party issued a cash bill No.1696 dated 5.10.2007 to the complainant. According to the complainant, when he started using the phone, it was found to be defective. The defect took place within the warranty period. Hence complainant seeking relief from opposite parties to replace the phone and also compensate for the loss and hardship suffered by the complainant. Opposite parties after duly serving notice called absent and set exparte. The complainant filed affidavit and Exts. A1 to A6 were marked. From the affidavit and Exts. A1 to A6, the complainant’s case is proved. In the result the petition is allowed and the opposite parties are directed to pay an amount of Rs.11,000/- to the complainant and also the complainant is entitled to get a compensation of Rs.1,000/-. The opposite parties are jointly and severally liable to compensate the petitioner. Pronounced in open Court this the 20th day of October 2008.
