ORDER:
Today the case is fixed for consideration on the point of maintainability.
The complainant has filed the present complaint u/s 35 of the Consumer Protection Act, 2019 against the opposite parties (hereinafter referred to as ‘OPs’) on the averments that one agent of OPs namely Munish Jain apprised the complainant about their scheme and stated that as and when the amount is required by the depositor, the same would be returned alongwith high rate of interest. The said agent collected the amount at Karnal and all the formalities were also completed in Karnal. The complainant was given application form no.080758020717 and opened an account no.22004801829. The OPs issued a passbook. Complainant deposited the amount with the OPs at Karnal through Munish Jain and all entries are made in the Member ledger. Complainant deposited a total sum of Rs.1,18,140/- with the OPs. On 30.03.2019, complainant visited the office of OPs at Karnal and requested to pay the abovesaid amount alongwith interest and also to pay dividend, but OPs postponed the matter on one pretext or the other and till today OPs have not released the said amount. Then complainant sent a legal notice dated 04.06.2022 to the OPs but it also did not yield any result. In this way there is deficiency in service on the part of the OPs. Hence this complaint.

3. A careful perusal of the complaint reveals that in the entire complaint nowhere is mentioned that how much and when the alleged amount has been deposited by the complainant with the OPs. Further, no maturity date has been mentioned. The record attached with the complaint is also not properly readable. Nobody appeared to defend the complaint. Without mentioning how much amount on which date deposited by the complainant and also without mentioning maturity date, it cannot be decided whether the present complaint is maintainable or not.
4. Hence, in view of the above, present complaint is devoid of merits and deserves to be dismissed and same is hereby dismissed at the stage of admission. However, complainant is at liberty to file a fresh complaint on the same cause of action by mentioning the deposition or maturity date, before the competent court of law, if so desired. The party concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
