FINAL ORDER / JUDGEMENT

Hazira is filed on behalf of the Complainant through Advocate.

No step is taken by the O.P.

The case is fixed for argument.

After hearing the argument from the Complainant the Commission proceeds to dispose of the case as hereunder: -

The Complainant being the owner of the property mentioned in Sch-A of this complaint entered into a joint venture agreement on 13-03-2012 with the O.P. to develop and promote the above property and in pursuance of that agreement the O.P. is to hand over possession of four nos. of shop room being Stall No.A3, B1, B2 and D3 in the Ground Floor and Flat No.B1, B2, B3 in the Second Floor. But before handing over possession of the owner’s allocation as above the O.P. sold out more than 70% area in the 1st Floor and made agreement for sale of a flat in the 3rd Floor. The Complainant through Advocate’s letter dated: 28-11-2016 asked the O.P. to abide by the terms and conditions of the agreement but finding no relief from the O.P. the instant case has been filed.

The O.P. contested the case by filing written version contending inter alia that all the four agreed shop rooms in the Ground Floor and Flats in the 1st Floor have already been handed over to the Complainants and so the Complainants have no cause of action to file the instant case. On the other hand the Complainants are alleged to be not allowing the entry into the newly constructed apartment causing great inconvenience to the O.P.

Having gone through the written complaint, written version and documents on record the Commission finds that the Complainants have not made out any case against the O.P. for breach of any terms and conditions of the agreement.

                                                                         Hence it is ordered……..

That the case is dismissed on contest but without cost.

Both parties be supplied copy of the order free of cost.
