ORDER

The instant Transfer Application is registered on the basis of a letter vide No.45 dated 18^th January, 2021 written by the President, District Consumer Disputes Redressal Commission, West Tripura, Agartala stating, inter alia, that the complaint petition filed by the complainants, Smt. Mousumi Rakshit and others cannot be taken up by him being one of the complainant, namely, Shri Bamdeb Majumder is known to him and the opposite party, M/s Roodraksh Realtors is also familiar to him. Thus, the matter may be transferred to any other District Commission within the jurisdiction of the State Commission for the interest of justice.  

Heard Mr. Koomar Chakraborty, Ld. Advocate appears on behalf of the complainants; who has no objection so far the prayer for transfer of the case is concerned.

In view of the above, the complaint petition being No.C.C.04/2021 is hereby withdrawn from the learned District Consumer Disputes Redressal Commission, West Tripura, Agartala and transfer the same to leaned District Consumer Disputes Redressal Commission, South Tripura, Gomati, Udaipur for deciding the case.

The President, District Commission, West Tripura, Agartala is directed to send the record of Complaint Case No.C.C.04/2021 to the learned District Commission, South Tripura, Gomati, Udaipur.

The President, District Commission, South Tripura, Gomati, Udaipur is also directed to issue notices upon the parties after receipt of this order as well as the case record for their appearance and decide the case in accordance with law.

Accordingly, the transfer petition is allowed.

Send down the records of C.C.04 of 2021 to the learned District Commission, West Tripura, Agartala for doing the needful.

Copy of this order be sent to the learned District Commission, West Tripura, Agartala and the learned District Commission, South Tripura, Gomati, Udaipur as well as the parties.
