        By this order we shall decide the question of admission of complaint. We have heard the Ld.Counsel for complainant and have gone through the record of the complaint case and relevant provision of law.

        The present complaint is filed by the complainant alleging that the Maruti Swift DZIRE Car was purchased by the complainant from OP-2 bearing registration No. DL-3C-BU 7913.  After delivery the complainant noticed that some noise in the car and got it checked. The complainant has alleged defects in the car and also deficiency in service on the part of OPs and has prayed for replacing the car with brand new one and award of compensation and costs of litigation.  During the course of arguments it is conceded by Ld. Counsel for complainant that the car in question was purchased by the complainant from Mathura Road Office at Mohan Cooperative Industrial Estate, New Delhi from OP-2.  The Head Office of OP-2 is at Nelson Mandela Road, New Delhi.  Both Mathura Office and Head Office of OP-2 are not within jurisdiction of this Forum.  Lt. Counsel for complainant has stressed that the Head Office of OP-1 is situated within territorial jurisdiction of this Forum.  In Civil Appeal No. 1560/2004 of M/S. Sonic Surgical Vs. National Insurance Co. Ltd. decided by the Hon’ble Supreme Court on 20/10/2009 it  has been held that the jurisdiction of that Consumer Forum would be attracted where the cause of action accrued wholly or partly and the branch office of the OP is situated. 

In the present case, the Branch Office of the Mohan Co.Op Industrial Estate of OP-1 is situated at  Mathura Road not within territorial jurisdiction of this Forum, the workshop where vehicle was taken for repair by the complainant is also at Mohan Cooperative Estate, Mathura Road not in territorial jurisdiction of this Forum.  Therefore, in the light of Sonic Surgical’s case (Supra) this District Forum has no jurisdiction to entertain and adjudicate the present case. The complaint be returned to the complainant alonwith documents after retaining the copies of the same to enable the complainant to file it before the competent District Consumer Disputes Redressel Forum.
