Heard Mr. Shankar Mukhopadhyay, the Ld. Advocate for the Decree Holder and Mr. Pravash Ghosh, the Ld. Advocate for the JDR.  It appears that both sides admitted that a sum of Rs. 4,00,000/- was deposited in compliance with the order of the Hon’ble National Commission which upon accumulation of interest has reached a higher figure.  Out the said amount the Decree Holder is entitled to Rs. 4,00,000/- along with interest @ 8% p.a. for the period indicated by the Hon’ble National Commission.  Both sides agreed that the Decree Holder is entitled to a sum of Rs. 7,16,600/- including said principal amount of Rs. 4,00,000/- and balance as aforesaid interest.  Therefore, the balance amount to which the Decree Holder has no claim is to be returned to the JDR.  The application is, therefore, allowed.  The sum of Rs.7, 16,600/- be paid to the Decree Holder and the balance amount of Rs.1,29,794/- be refunded to the JDR.  Such payment be made within a period of three weeks from the date of the order.
