Today is fixed for admission hearing.

The complainant is absent on repeated calls. None for the complainant is present and no steps is taken.  On scrutiny of the complaint petition it appears that the complainant resides at Dumdum, Kolkata-700028, P.S.-Nager Bazar which is outside the jurisdiction of this Commission even the OPs-1 and 2 carry their business beyond the jurisdiction of this commission and hence, it will attract Section 34 (2)(b) of the C.P. Act., 2019 but no petition has been filed by the complainant on the above.  Besides that the instant consumer complaint was filed by the complainant on 29.07.2024 and as such 21 days from the date of filing of the instant case is over today.

In view of the above, we are not inclined to admit the Consumer Complaint in hand in its present form and rejected accordingly.

However, liberty is given to the complainant to file afresh on the same cause of action in appropriate Commission, if so advised, and if not, otherwise barred by law.
