(1)               There is an alleged delay of 84 days in filing the appeal.  Hence, the application for condonation of delay is made.    It is submitted in Para No.7 & 8 of the application that due to business commitment,  applicant/appellant had to remain out of station and that caused the delay in filing the appeal.  It is always desirable to allow the parties to contest the Lis on merit.  Therefore, considering reasons given in the application, and the fact that the same are not contradicted by respondent/non-applicant, we find the delay is satisfactorily explained.  Application deserves to be allowed subject to the costs.  Holding accordingly, we pass the following order. 

ORDER

(1)     The application for condonation of the delay is allowed and the delay in filing the appeal stands condoned, subject to payment of costs of `2,000/- which shall be paid before the next date in appeal.
