ORDER

Vide Agreement dated 29.08.2011, the complainant agreed to purchase the flat measuring 1609 sq. ft (super area) for an amount of Rs.52,81,319/-. Till the time of filing this complaint, the complainant had paid an amount of Rs.49,90,047/-. As per terms and conditions of the Buyer’s Agreement, possession was to be delivered within 30 months from the date of sanctioning of the layout plans i.e. 18.01.2012. Admittedly, possession has not yet been delivered. Under above circumstances, this complaint was filed seeking refund of amount paid with interest and compensation etc.

                   At the time of arguments, the matter has amicably been settled between the parties.

                   It is stated by Sh.Rohit Tanwar, AGM (Legal) of Opposite Party No.1 that flat will be ready for possession within four weeks from today.

                   The complainant, who is present in Court, states that he is ready to take possession, subject to making the balance payment towards price and grant of compensation.

                   In view of above, this matter is disposed of with a direction to Opposite Party No.1 that possession of the unit, in question,  be handed over to the complainant, complete in all respects on or before 08.08.2018 and further compensation be paid to the complainant for the delayed period i.e. starting from 18.07.2014 @9.5% p.a. (simple). The said amount be assessed and upto the date of handing over the possession, after deducting the amount payable towards price of the flat shall be paid to the complainant in two equated installments i.e. first installment be paid within six weeks from the date of handing over the possession and the next within further period of six weeks, failing which, the entire amount will entail penal interest @12% p.a. till the time of making the payment. This order passed shall be treated as an executable decree.

                   Certified copies of this order be sent to the parties, free of charge.
