This is a complaint filed by the complainant U/S 35 of the Consumer Protection Act 2019 for an order directing the OP to refund the value of sofa for of Rs.60,000/- and the value of fabrics for Rs.15.994/- to the complainant along with compensation for mental agony of the complainant for Rs.25,000/- and cost Rs.5,000/- for the deficiency of service and unfair trade practice on the part of OP.
The brief of the complaint :
The complainant is conducting a shop in the name and style “My sofa Kannur” for her own self employment and her livelihood. On 20/2/2023 the complainant booked Fabrics used for sofa having description as “Hummer C88 total 40 meters at the rate of Rs.351/- per meter. Then the complainant paid Rs.15,994/- to OP for the goods. At the time of purchasing the fabric the OP assured that the fabric is of good quality and free from any defect. On receipt of the goods from OP the complainant manufactured the sofa with Fabrics. The item when sold to customer found the fabric supplied by OP is very low quality and defective hence returned. The sofa set is now kept idle having MRP Rs.60,000/-, the complainant is not able to use the balance fabric also. The complainant informed the mater to OP. But the OP is not settled the matter. The act of OP the complainant caused much mental agony , financial loss and loss of brand name also. So there is deficiency of service and unfair trade practice on the part of OP. Hence the complaint.
After filing this complaint, notice issued to OP . The OP received the notice and not appeared before the commission and not filed version . The commission had to hold that the OP’s not appeared before the commission and no version filed. As such this case came to be proceed against the OP as set exparte.
Even though the OP remained ex-parte it is for the complainant to establish the allegations made by her against the OP. Hence the complainant was called upon to produce evidence in the form of affidavit and document. Accordingly the complainant has chosen to produce her affidavit along with one document marking them as Ext.A1. The complainant was examined as PW1. So the opposite party remain absent in this case. At the end the Commission heard the case on merit.
Let us have a clear glance at the relevant document of the complainant . On 20/2/2023 the complainant booked Fabrics used for sofa having description as hummer C-88 total 40 per meter and she paid Rs.15,994/- to OP’s south Indian Bank Account Bangalore, dtd. 20/2/2023 with reference No.29249 as shown in the tax invoice and marked as Ext.A1. After receiving the goods from OP the complainant manufactured the sofa with fabrics. Then the complainant sold the sofa to the customer and the customer found the fabric supplied by OP is very low quality and defective and returned to the complainant. The sofa set is now kept idle having MRP Rs.60,000/-. The complainant is not able to using the balance fabric also. Immediately the complainant informed the matter to OP. But the OP is not ready to cure the defected goods also. So the OP is directly bound to redressal the grievance caused to the complainant. Therefore we hold that the OP liable to refund Rs.15,994/- to the complainant. The complainant already paid Rs.15,994/- to OP for the cost of fabrics along with Rs.10,000/- as compensation for mental agony caused to the complainant and Rs.3000/- as litigation cost to the complainant.
In the result, the complaint is allowed in part directing the opposite party to refund the cost of fabrics Rs.15,994/- to the complainant along with Rs.10,000/- as compensation for mental agony caused to the complainant and Rs.3000/- as litigation cost within 30 days of receipt of this order. In default, the amount of Rs.15,994/- carries interest@ 12% per annum from the date of order till realization , failing which the complainant is at liberty to execute the order as per the provision of Consumer Protection Act 2019. After the said proceedings the opposite party is at liberty to take back the Fabrics from the custody of the complainant .
