Nand Lal Versus M/s Phonak India Pvt. Ltd.

CC No.384 of 2016.

 

Present: Sh. Nand Lal Complainant in person with counsel Sh. Harinder Kumar Adv.  

Sh. Sheel Chand Saini Director Surya Clinic with counsel Sh. Gaurav Sharma Advocate on behalf of OPs.

 

                        Vakalatnama filed on behalf of OPs. Sheel Chand Saini, OP No. 3 director of OP No.2 appeared before this Forum in person and made a statement recorded separately that a compromise has taken place with the complainant and a cheque of Rs. 2,00,000/- bearing No. 972947 dated 06.12.2016 drawn on Overseas Bank had already been handed over to the complainant being a full and final payment and he has received the old machine/ instrument from the complainant. The complainant who is also present in the court also made a statement recorded separately that he has received a cheque of Rs. 2,00,000/- bearing No. 972947 dated 06.12.2016 as full and final payment and he does not want to pursue the present complaint.       Parties also placed on file written compromise on the file which was marked as Annexure CX.

                        In view of the statement recorded separately of both the parties as the matter has been patched up between the parties. Hence, the present complaint is hereby disposed off accordingly. Copies of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
