The Complainant has filed the present complaint under Section 35 of the Consumer protection Act, 2019.

1. The case of the Complainant is that he is constrained to file the present complaint against the Opposite Parties on account of the illegal actions of the Opposite Parties including inter alia, indulging in unfair trade practices for the purpose of promoting the sale, use and supply of their good. Further, the Opposite Parties have also published misleading advertisements in relation to their product Patanjali Honey manufactured by Opposite Party No.1 and marketed and made available for sale by Opposite Party No.2.  On October 08 2023 the Complainant came across an advertisement published on behalf of the Opposite Parties for their product Patanjali Honey. The Complainant also came across a video made available by and on behalf of the Opposite Parties on the platform Youtube. It is submitted that the said video uploaded on Youtube is also an advertisement to promote the sale of the impugned product. The perusal of the impugned advertisements demonstrate that the Opposite Parties have made the following claims in relation to the impugned product.

1. World’s best.

2. Patanjali honey was tested in world’s renowned labs and it was 100% pure.

3. It has proved its purity on more than 100 parameters.

The Complainant stated that relying on the aforementioned advertisement and representation made in the impugned advertisements the Complainant purchased the impugned product for an amount of Rs. 210/- from a Patanjali retail outlet. The Complainant bought the impugned product primarily on the basis of the representations made by the Opposite Parties. It is however submitted that the said representations and claims made by the Opposite Parties in their advertisements are false and misleading.
3. As per section 10 of the Consumer Protection Act, 2019

10. Establishment of Central Consumer Protection Authority.

(1.) The central Government shall, by notification, establish with effect from such date as it may specify in that notification, a Central Consumer Protection Authority to be known as the Central Authority to regulate matters relating to violation of rights of consumers, unfair trade practices and false or misleading advertisements which are prejudicial to the interests of public and consumers and to promote, protect and enforce the rights of consumer as a class.

 

4. In view of the above mentioned Section 10 of Consumer Protection Act, 2019,

we did not see any ground to admit the complaint. Therefore, the complaint is dismissed.

5. Order announced on 25.01.24.

Copy of this order be given to the Complainant free of cost.
