ORDER
NARESH KATYAL, JUDICIAL MEMBER:
This complaint is fixed today. Misc. Application No. 10 of 2024 was filed on 11.01.2024, jointly by complainant, as well as, by opposite party to withdraw the complaint. It is supported by affidavit of Pawan Singla-complainant and also affidavit of Sh. Shailendra Modi-Assistant General Manager of opposite parties.
2. Sh. R.C. Sharma, Advocate for complainant and Sh. Satpal Dhamija, Advocate for opposite parties are present. Sh. R.C. Sharma has suffered following statement on oath:-
“Stated that: entire grievance of complainant has been settled by complainant, mutually with opposite parties, to his full and final satisfaction. Memorandum of Understanding has been framed between complainant and opposite parties which is Annexure A-1 and same bears signature of complainant, as well as, representative of opposite parties. There is no subsisting grievance of complainant against opposite parties. I have instructions from complainant to make this statement for withdrawing the complaint. Accordingly, as per instructions from complainant I withdraw this complaint. I further state that in case opposite parties resile or deviate from Memorandum of Understanding Annexure A-1, then I seek liberty on behalf of complainant to file fresh complaint on same cause of action.”

In light of facts so emerging from reading of statement of learned counsel for complainant and on perusal of MA No. 10 of 2024 along with affidavit of complainant and Assistant General Manager of opposite parties; M.A. No. 10 of 2024 is allowed and liberty is granted to complainant, through his counsel to withdraw this complaint being fully satisfied and there being no subsisting/pending grievance of complainant against opposite parties. This Complaint is disposed off, as withdrawn as genesis of matter involved in this complaint has been amicably settled by complainant with opposite parties. Liberty is granted to complainant to file fresh complaint on same cause of action, in case opposite parties resile or deviate from agreed Memorandum of Understanding Annexure A-1. It is ordered accordingly.
4. A copy of this order be provided to both parties, free of cost, as mandated by the Consumer Protection Act, 1986/2019. This order be uploaded forthwith on the website of the Commission for the perusal of the parties. Complaint file be consigned.
