This appeal is directed against the order dated 22/09/2004. Passed by the District Forum, Dimapur in FA no. 5/2003. By this impugned judgment the learned District Forum has dismissed the complaint petition on the ground of lack of jurisdiction.

After hearing the learned counsel for the appellant Shri P B Paul, at some length the learned counsel for the appellant sought leave of this Commission to allow the appellant to withdraw the appeal with the liberty to file a fresh complaint before a competent District Forum in Assam.

In view of the aforesaid submission of the learned counsel the appeal stands closed. The appellant is at liberty to approach a competent District Forum in Assam, provided the same is maintainable in law
