In brief, the grievance of the complainant is that she had opened her account vide registration No. U-22174867 with the OP for sage and gain something on her earned money and she deposited Rs. 450/- per month as installment & the maturity date of this account was fixed 25.02.2014 by the company. It is alleged that she had paid all the installment to the company. It is alleged that since about more than 1 year have lapsed to mature the account/policy as well as deposition of bonds etc. to the company for getting the full and final matured value, but till date the OP not paid nothing to her. The complainant further alleged that due to the act and conduct of the OP she has to suffer harassment mentally, physically and economically. Hence, it amounts to deficiency in service on the part of OP and as such, she has to file the present complaint for matured amount alongwith interest and compensation on account of harassment.
2. OP has failed to come present. Hence he was proceeded against exparte vide order dated 04.05.2016.
3. In order to make out his case, the counsel for complainant has tendered into evidence Annexure C-1 & Annexure C-2 alongwith supporting affidavit.
4. We have gone through the record of the case carefully and have heard the counsel for the complainant.
5. Learned counsel for the complainant reiterated the contents of the complaint. He submitted that the complainant deposited the documents vide acknowledgment dated 25.02.2014 Annexure C-1 with the OP, for the payment of the maturity amount. The OP has failed to pay the maturity amount to the complainant.
6. The representative of the OP appeared in this case even after taking adjournment failed to file the written statement and became absentee. Hence he was proceeded against exparte. The pleadings of the complainant has not been rebutted on behalf of the OP. Keeping in view the facts and circumstances of the case, we allow the complaint of the complainant and direct the OP to pay the maturity amount to the complainant alongwith interest at the rate of 9 per cent per annum from the date of maturity till the date of payment and also to pay Rs. 1500/- as litigation cost to the complainant. It has been brought to our notice that the accounts of OP company have been freezed by court order. As soon as the bank accounts of the OP are made operational, the OP is directed to comply with this order. Certified copies of the order be sent to the parties free of costs. File be consigned to the record room, after due compliance.
