- The case of the complainant is that in Jharsuguda Airport, the complainant purchased two Amul Cool bottles and three petties from the Opp.Party for a n amount of Rs.270/- on 14.03.2021. When the complainant asked the Opp.Party about the cost the O.P told that each petties cost of Rs.70/- and Amul Cool Rs.20/. On enquiring about maximum retail price (M.R.P) the O.P. answered in a rude manner “HAMARA COOLING AUR MAINTENANCE KA KHARCHA HAI LENA HAI TOA LO NAHI TOH JAO” when bill was demanded the O.P became furious and scolded “SAALE KAHAN KAHAN SE AA JATE HAIN DUS RUPAYA DENEKA AUKAT NABHIN AUR AA JATE HEIN FLIGFHT ME BAITHNE” After that people gathered and the O.P gave a bill No.151 dtd.14.3.2021.
Being aggrieved the complaint was filed.
- The Opp.Party after notice also did not turn up and set exparte.
- Perused the Bill No.131 dtd.14.3.21 of Amul Cool Bottle showing price as Rs.20/-, spice-jet ticket having PNR-L 8BH6 S/SG Dtd.14.03.2021
- After perusal of the documents it is observed that on 14.3.20221 the complainant was on a trip from Jharsuguda to New Delhi and purchased three petties and two Amul cool for Rs.270/-. The maximum retail price of Rs.20/- charged Rs30/- from the complainant and the O.P has taken excess amount of Rs.20/- . The O.P can not charge excess then the M.R.P but in the instant case charged Rs.20/- excess which is an UNFAIR TRADE PRACTICE. Further the behavior of the Opp.Party towards a customer is against the business norms and unwarranted.
Any person having capacity to pay flight fair can move though the flight and the airport authority should control in its business premises such unfair means and exploitation of the customers.
Taking into consideration the circumstances following order is passed:
ORDER.
The complaint is allowed exparte against the O.P. he O;.P is directed to refund Rs.20/- with 9% interest per annum w.e.f. 14.03.2021 within one month of this order. The O.P is directed to pay compensation of Rs.10,000/- towards harassment and mental agony of the complainant . For unfair trade practice the Opp.Party is directed to pay Rs.40,000/- to consumer Welfare Funds of the State . The Opp.Party is to pay litigation expenses of Rs.5,000/- to the Complainant .
Order pronounced in the open Court today on 2nd day of May, 2023.
