            The petition was filed on 27/02/2013. The gist of the complaint is that the complainant entrusted a parcel containing sixty number of micromax internet modems to the 1st opposite party in order to deliver at Trivandrum Complainant had given a copy of the bill showing the value  and nature of the materials in the parcel also. But the parcel did not receive the addressee so far. Hence this complaint.

            Notice issued to both parties which served upon them. But there was no representation or version on their part. Thus opposite party set exparte on 04/08/2014.

            Complainant filed chief affidavit and examined as PW1 ext. A1 to A4 were marked on the side of the complainant. A1 is the bill copy issued by 1st opposite party. A2 is the bill showing the value of the modems. A3 and A4 are the notices issued by the counsel concerned to the opposite parties. Ext A1 and A2 clearly shows that complainant entrusted 60 modems worth Rs.87,000/- to the 1st opposite parties  on 24/11/12. There is nothing to disbelieve the allegation of the complainant. And there was no cross examination or documents produced on the part of the opposite party. Thus complainant proved his case before this Forum. In the result, petition is allowed in part.

            Therefore we are of the opinion that the opposite parties are jointly and severally liable to pay Rs.87,000/- to the complainant as the cost of the modems. Comply the order within one month from the date of the order.

Pronounced in the open court this the 17th   day of December 2014.
