CONSUMER COMPLAINT NO. 687  OF  2021

ORDER

1.        The parties have settled the matter. Vide separate statement, Sh.Vishal Chawla, Assistant Manager Legal alongwith Sh.Arjun Sharma, Counsel for OP has stated that the matter has been settled between the parties with the term that the OP shall pay an amount of Rs.15,21,000/- to the complainant, which include principal amount, interest & litigation costs and the said amount shall be paid within one month from today. It has been further stated that on the payment of aforesaid amount, the complainant shall not have any right, title or interest in the property in question. It has been further stated that in case the OP makes default in payment of the aforesaid amount within the stipulated period, then OP shall be liable to pay the aforesaid amount alongwith interest @ 9% p.a. from the date of filing of present complaint till its realization. Vide his separate statement, the complainant has admitted the aforesaid statement of Sh.Vishal Chawla, Assistant Manager Legal of OP alongwith Sh.Arjun Sharma, Counsel for OP and prayed that the complaint be disposed off in terms of aforesaid settlement.

2.        In view of the statements of the parties and in terms of the settlement, the complaint stands disposed off by passing the following order:-

     (i)  The OP shall pay an amount of Rs.15,21,000/- to the complainant, which include principal amount, interest & litigation costs, within one month from today.

     (ii) On payment of the aforesaid amount by the OP,   the complainant shall not have any right, title or    interest in the property in question.

     (iii) In case OP fails to pay the aforesaid amount   within the stipulated period, then OP shall be liable to   pay the aforesaid amount alongwith interest @ 9% p.a.      from the date of filing of present complaint i.e.     08.10.2021 till its realization.

     (iv)   No TDS shall be deducted by the OP from the   aforesaid amount.

3.        The complaint is disposed off accordingly.

4.        Certified copies of this order be sent to the parties free of cost. The file be consigned.
