ORDER
The matter has amicably been settled. It is stated by Sh. Munish Gupta Advocate, Counsel for the Opposite Parties that the entire amount paid by the complainant shall be returned to the complainant with interest @9.25% p.a. (simple) leviable w.e.f. the dates of respective payments made. It is further stated that the payment will be made in four installments on the following dates, by adding interest on the principle of diminishing balance:- 1st Installment - 15.10.2017 2nd Installment - 15.12.2017 3rd Installment - 15.02.2018 Last Installment- 15.04.2018 It is further stated that towards cost of litigation, the Opposite Parties will pay an amount of Rs.50,000/-. The said amount will be paid with the last installment. It is further stated that the post-dated cheques will be handed over to the complainant on or before 15.09.2017. Offer made is acceptable to the complainant, who is present in person alongwith her counsel. It is further stated that in case any cheque on presentation is not honoured, the complainant/her counsel will immediately intimate Sh. Puneet Popli, Sr. Legal Manager of the Opposite Parties on his Mobile Nos.9711777707 & 9999534220 through SMS. Upon doing so, within next five working days, if demand draft of the defaulted amount is not sent/handed over to the complainant, for each default, the Opposite Parties will pay an amount of Rs.30,000/- and it shall also be open to the complainant to file Execution Application. In above said circumstances, this Execution Application stands disposed of. Certified copies of the order be sent to the parties free of charge. |
