In terms of order passed by us on 21.07.2017, Counsel for the Opposite Parties has placed on record one affidavit, Paras 2 & 3 which reads thus:-

“2.     That the green area on the backside is available exclusively to the allottee, who is on the ground floor, raised on the silt parking. Said area is his personal space and not meant for user by any other person on any other floor.

3.       The one car parking each, in the stilt area, shall be provided free of cost to allottee’s per unit/floor. The second car parking can be opted by the allottee upon making payment. In case allottee does not opt for the second parking, the unallotted car parking shall remain the property of the Developer and the Developer shall be at liberty to allot the same to any other allottee.”

                   It is specifically stated that some green area is available at the back side of the ground floor raised on the stilt parking which shall exclusively be used by the allottee of the said floor. It is further stated that one car parking under the stilt will be provided free and if more space is needed, for that, price will be charged. Both the parties are in Agreement that issue involved is squarely covered by ratio of the judgment of this Commission passed in the case of ‘Dharamjeet Taunque & Anr. Vs. M/s Omaxe Chandigarh Extension Developers Pvt. Ltd.’, Complaint Case No.189 of 2016, decided on 21.04.2017.

                   In view of above, this complaint is also disposed of in the same terms as in the case of Dharamjeet Taunque (Supra). The complainant, in this case, is held entitled to the same relief/benefits, as given to Sh.Dharamjeet Taunque, in the aforesaid judgment.           

                   Certified copies of this order be sent to the parties, free of charge.
