Rohan Goel filed a consumer case on 01 May 2018 against M/s Omaxe Chandigarh Extension Developers Private Limited in the StateCommission Consumer Court. The case no is CC/771/2017 and the judgment uploaded on 10 May 2018.
At the time of arguments, the matter has amicably been settled between the parties.
It is stated by Sh. Ashim Aggarwal, Advocate, Counsel for the Opposite Parties, on getting instructions from Sh. Deepanjit Singh, Senior Manager (Legal) that the Opposite Parties are ready to refund the amount paid by the complainants viz. Rs.36,15,264/- alongwith interest @8% p.a. (simple) from the date of respective deposits made, in four equated installments and the payment shall be made in the following manner :-
1st Installment | - | Rs.9,03,816/- + interest on the said amount of Rs.9,03,816/- from the respective date of deposit till 31.05.2018. Demand draft qua the aforesaid amount shall be handed over on 01.06.2018. |
2nd Installment | - | Rs.9,03,816/- + interest on the said amount of Rs.9,03,816/- from the respective date of deposit till 31.07.2018. Demand draft qua the aforesaid amount shall be handed over on 01.08.2018. |
3rd Installment | - | Rs.9,03,816/- + interest on the said amount of Rs.9,03,816/- from the respective date of deposit till 30.09.2018. Demand draft qua the aforesaid amount shall be handed over on 01.10.2018. |
4th Installment | - | Rs.9,03,816/- + interest on the said amount of Rs.9,03,816/- from the respective date of deposit till 30.11.2018. Demand draft qua the aforesaid amount shall be handed over on 01.12.2018. |
The abovesaid offer is acceptable to the Counsel for the complainants.
In view of above, this complaint stands disposed of having become infructuous.
However, we make it very clear that in case, any default is committed in making the payment, as referred to above, for each default, on the defaulted amount, the complainants shall continue to get interest at the rate referred to above till the time of making the payment. Further for each default, the complainants shall be entitled to penal amount of Rs.30,000/-. Further, it is made clear that this order shall be treated as an executable decree and if need be, it shall be open to the complainants, in case of not making the payment, as committed, to get it executed, as per law.
Certified copies of this order be sent to the parties, free of charge.
