At the time of arguments, the matter has amicably been settled between the parties.

                        We appreciate the stand taken by both the parties.

                        In continuation of our order passed on the last date of hearing i.e. 06.04.2018, Counsel for the Opposite Party, on getting instructions, states that possession of the built up flat bearing No.499, Ground Floor in the developed project will be delivered to the complainant on or before 17.07.2018. It is further stated that whereof 28.11.2014, on the total amount deposited by that time, the Opposite Party shall pay an interest @8% p.a. (simple) on the amount so deposited.

                        The aforesaid offer made is acceptable to the complainant.

                        In view of above, this complaint stands disposed of.

                        The amount payable by the complainant will be adjusted in the interest to be granted at the time of handing over of possession. The interest will continue to accrue till the time possession is handed over. After making the adjustments, the balance due amount shall be paid by the Opposite Party in three equated monthly installments. It is further agreed that interest on delayed payment will be charged @8% p.a. (simple) for the delayed period. We are of the opinion that it is a case where some compensation needs to be granted in favour of the complainant and accordingly, we order that let Rs.50,000/- be also paid in addition to the agreed amount, as mentioned above. We make it very clear that in case, possession is not so offered then the complainant shall be entitled to get interest @12% p.a. from the date of end date of possession i.e. 17.07.2018 till the date of actual handing over of possession.

                        Certified copies of this order be sent to the parties, free of charge.
