EA No.13 of 2021.

Ishwar Singh vs. Oberoi Automobiles

 

Present:      Sh. Jaspal Kamboj, Adv. for the petitioner-applicant.

                   Sh. Jasbir Singh Rana, Adv. for the IDFC First Bank.

         

                 In order to, do the compliance of order dated 27.08.2019, passed by Haryana State Consumer Disputes Redressal Commission, Panchkula, in FA No.312 of 2019, with regard to hand over the delivery of the car, subject matter of the Consumer Complaint No.432 of 2016, ultimately, Court Commissioner, was appointed by this Commission, with the purpose to get the premises of the Oberoi Automobiles opened, being sealed by the IDFC First Bank, but the Court Commissioner submitted his report on today, which is not disputed and he submitted due to bad condition of the car, subject matter of original complaint, the petitioner was not ready, to take, the delivery of the car, which was in a bad condition. This Commission cannot force the petitioner Ishwar Singh, to take the delivery of car, bearing Registration No. HR02-AC-4505. No further, action, in the matter is warranted by this Commission and the petitioner Ishwar Singh shall be at liberty to raise his, legal grievance, by filing separate complaint or by filing civil suit, if desires so, with regard to claim damages, from the person/entity concerned and the record of the application dated 22.4.2021 is hereby ordered to be consigned to the records, treating it unsatisfied.
