Final Order / Judgement

                            Heard Mr. M. Islam, learned counsel appearing for the complainant and Mr. S. K. M. Hussain, learned counsel appearing on behalf of the opposite party. As the complainant was heavily relying on a report submitted by Sub Divisional Agriculture Officer, South Salmara, Mankachar Sub Division, this Commission took a view that the concerned S. D. A. O. should be brought on record, as respondent/proforma respondent so that he can be examined in connection with the statement given by him in his report.

                           Pursuant to the opinion expressed by us on 9-1-2012, the complainant has filed an application dated 12-3-2012 praying for impleading one Md. Saidul Islam Khandakar who was the concerned S. D. A. O., as respondent No. 6 in this complaint. Mr. Hussain, learned counsel appearing for the opposite party who has already been furnished a copy of the application, submits before the Commission that the Commission may take any decision on the prayer of the complainant, if so pleased. 

                                We have carefully gone through the application for impleadment, but there is no relief sought against the concerned S. D. A. O. as such, Md. Saidul Islam Khandakar, S. D. A. O., South Salmara, Mankachar Sub Division shall be impleaded as proforma respondent No. 6 in this complaint petition and the complainant shall take step for service upon the newly impleaded proforma respondent No. 6 by registered post with A/D within one week from today. In addition to the service by registered post with A/D, the complainant is also directed to serve a copy of this complaint petition by dasti service and once the dasti service is completed, an affidavit shall be filed by the complainant by way of proof of service. Mr. Hussain, learned counsel appearing for the opposite party submits that written statement has already been submitted on behalf of the opposite party before respondent No. 6 was impleaded as proforma respondent therefore, he would like to file additional written statement. 

                         The prayer for filing additional written statement is allowed but the same shall be confined to the fact and event associated with the newly impleaded respondent. 

                                   List the matter on 10-5-2012. 

                                  The Misc case No. 34/2012 stands disposed. 

                                The order passed in this case shall be applicable in C.C. 7/10 and the Misc case No. 33/2012 filed in connection with C.C. 7/10 also stands disposed.
