The case is fixed for further Admission hearing.

The Complainant has filed the instant case against the O.P./ Builder with the direction to refund Rs.3 Lakh on the ground that the Four Wheeler Car Parking space allotted to the Complainant by execution of the Sale Deed dated: 29/10/2021 is not suitable for use and enjoyment. Allotment of Car parking space has already been made by Deed of Conveyance dated: 29/10/2021 against the payment of Rs.3 Lakh and this Commission has no jurisdiction to cancel the sale transaction of the Car Parking Space by refunding the price thereof to the Complainant.

In view of Section 11(4)(a) of the Real Estate Regulation and Development Act, 2016 the liabilities and responsibilities of the Builder exists as per the Agreement for sale till the execution of the Deed of Conveyance and as such once sale is complete in respect of the Garage by execution of the Deed of Conveyance the Commission has no jurisdiction to declare the said transaction as invalid.

Hence it is ordered…

That the instant complaint case is liable to be dismissed on Admission point. However the matter is left for consideration by the O.P./Builder to refund the sale price of the Garage for Rs.3 Lakh on cancellation of the sale transaction dated: 29/10/2021 to that effect.

Both parties be supplied copy of this order free of cost.
