                                                            ORDER

 

                            This case has been taken up today in the Lok Adalat.. Efforts were made to settle the matter, which stood fructified and the parties have settled the dispute. Statement given by them is reproduced as under:-

“Statement of Sh.Kamal Kant Jain, Partner of OPs alongwith Counsel Sh.Munish Goel, Adv. for OPs.

 

I have received the original ring having the gold weight of 6 grams and diamond weight of 1.11 ct. along with the valuation certificate from the complainant, as we have paid a sum of Rs.1,05,000/- to the complainant i.e. Sh.Jain Parkash today in the court as full and final settlement of his claim. We have handed over the cheque no. 089394 dated 24.09.2010 of State Bank of Patiala for Rs.1,05,000/- to the complainant.  I shall be responsible for the clearance of the cheque as soon as the same is presented before the Bank.

 

Statement of Sh.Jain Parkash, complainant in person alongwith Sh.Parmod Kumar, Adv. for complainant

 

I state that I have settled the present complaint with the OPs by returning the original ring having the gold weight of 6 grams and diamond weight of 1.11 ct. along with the valuation certificate as the OPs have agreed to pay a sum of Rs.1,05,000/- to me in full and final settlement of my claim. The OPs has tendered cheque no. 089394 dated 24.09.2010 of State Bank of Patiala  for Rs.1,05,000/- and I have duly received the same. The ring was got valued vide certificate no. ODGLJ41003170475 issued by OM Diamond and Gems Laboratory, Sector 23 C, Chandigarh.  I withdraw my present complaint subject to encashment of the aforesaid cheque”.

 

2.                     In view of the above statements, the complaint stands dismissed as withdrawn. However, the parties would remain bound by their undertakings.

3.                     Copies of this order free of cost be supplied to the parties. The file be consigned.
