As a part of execution proceedings, the OPs filed an M.A No.102 of 2016 dated 19.12.2016 praying that the amount of Rs.1.5 lakhs already deposited with the District Forum may kindly be ordered to be released to the complainants/DHs in terms of the order (Annexure A-1) passed by the Hon’ble State Commission, UT, Chandigarh and the remaining amount which is in excess of the order may kindly be refunded to the OPs/JDs alongwith interest accrued thereon.
In the meantime, the complainant filed an M.A dated 26.12.2016 in the aforesaid M.A. No.102 of 2016 asking for payment of Rs.1.5 lakhs and some other amount totaling to Rs.2,70,250/- + Rs.5,000/-. In the said M.A, the OPs filed reply dated 28.12.2016 stating that the amount of Rs.1.5 lakhs may be ordered to be released in favour of the complainants/DHs and the remaining amount be released to the OPs/JDs. During the proceedings of the present M.A. No.102 of 2016 only, an order was passed by this Forum on 28.12.2016 asking the office to release the amount of Rs.1.5 lakhs in favour of the complainants/DHs. It is also to be noted that the sum of Rs.1.5 lakhs has already been received by Sh. Ramesh Chander Khurana, the authorised representative of the complainants as per the order dated 30.1.2017. As far as the claim of the complainants for the remaining amount is concerned, since the amount of Rs.1.5 lakhs has already been paid to them, which has also been duly acknowledged by their authorised representative, in our opinion nothing remains pending. As such, M.A. No.102 of 2016 filed by the OPs as well as M.A. dated 26.12.2016, filed by the complainant, stands disposed of being fully complied with.
Parties are left to bear their own costs.
The certified copies of this order be sent to the parties free of charge. The files be consigned.
