Today, the case was fixed for the evidence of the Complainant. At this stage, the Complainant has made the following statement: -

“Stated that complainant wants Hand Writing expert opinion qua the receipt produced by respondents alleged to be executed by complainant. As practice of expert opinion is not permissible with the Consumer Forum, so he does not want to proceed further and withdraw the present complaint with liberty to file the fresh complaint with the competent court. The time spent by the complainant before this Forum may pleased be excluded while computing the period of limitation prescribed for such a suit under the law.”

In view of the aforesaid statement of the Complainant, the instant complaint is dismissed as withdrawn.  However, the Complainant is at liberty to approach the competent court of law for the redressal of his  grievances, if he so desires, for which the time spent before this Forum shall stand excluded under Section 14 of the Limitation Act in the light of the judgment of the Hon'ble Supreme Court in case titled 'Lakshmi Engineering Works vs PSG Industrial Institute reported in 1995(3) SCC 583'. Copy of this order be supplied to the parties free of cost and thereafter, the file be consigned to record room.
