Present:- Proxy Counsel Sh.Amritpal Singh, Adv. for Complainant.

Proxy Counsel for complainant request for adjournment for depositing the publication fee.

Perusal of record shows that in this complaint, vide order dated 17.3.2020, Notice was issued to OPs No.1 to 5 for 23.4.2020 and summons of OPs No.1 to 4 were received back with postal remarks that “Left without address” and Regd.Cover of OP No.5 was received back with postal remarks that “Office Locked” and then case was adjourned till 06.10.2022 for filing correct address of OPs, but correct address of OPs not filed.

Thereafter, on 14.11.2022, Counsel for complainant moved application for issuing publication notice to OPs. The service through substitute service i.e. by way of publication in Nawan Zamana was allowed. Since 14.11.2022 to 2.5.2023, the case was adjourned for depositing publication fee in this Commission for publication notice to OPs. On 5.6.2023, proxy Counsel for complainant stated that the address of OPs No.1 to 4 are at District Fazilka and address of OP No.5 is at Sahibzada Ajit Singh Nagar. On request of complainant, publication notice to OPs in “The Tribune” newspaper was issued. Since 5.6.2023 till today, i.e. on 20.02.2024, as per report of Ahlmad, publication fee not deposited by the complainant in this case. It seems that the complainant is not interested to persue the present complaint and lingering on the matter on one pretext or the other. The complaint can not be decided on merits as the OPs are not served due to non-filing of correct address and Publication fee, so the present complaint is disposed of for want of prosecution. File be consigned to the record room.
