Complaint under section-12 of Consumer Protection Act, 1986

ORDER:  

                        Today the case was fixed for compromise.

                        Shri Anuj Gupta, counsel for opposite parties Nos.1 & 2 has made a statement that  “I being the authorized representative of M/s. National Insurance company, am ready to settle the present matter for amount of Rs.42,635/-  towards mediclaim in full and final settlement, towards the claim of the complainant in the present complaint and nothing is due to the insurance company.  A period of 45 days may be given to make the payment of said amount by the insurance company.”    

                        Shri Balbir Singh complainant has made a statement that “I have heard the statement of the counsel for the insurance company and offer is acceptable to me and to settle the present matter for an amount of Rs.42,635/- towards mediclaim in full and final settlement towards my claim, in the present complaint.  Hence, the matter may kindly be disposed off accordingly.”

                        On the basis of the statement of the counsel for the parties, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party to pay an amount of Rs.42,635/- as full and final settlement towards the claim of the complainant.  There are no order as to costs.  Compliance of this order  be made within 30 days from the date of receipt of copy of this order.  File be consigned to the record room.
