Today the case was fixed for compromise if any before National Lok Adalat.
Shri Sachinder Bhatia, counsel for opposite party has made a statement that “I being the authorized representative of Insurance Company, am ready to settle the matter for Rs.48,450/- as full and final settlement towards the claim of the complainant in the present matter, subject to submission of cancellation of RC, Form 29,30 & 35 NOC and letter of subrogation. A period of 45 days, may kindly be granted to make the payment of said settlement amount by the insurance company.
Complainant Prem Kumar has made a statement that “I have heard the statement of counsel for opposite party and ready to settle the matter for Rs.48,450/- as full and final settlement towards my claim, subject to submission of cancellation of RC, Form 29,30 & 35, NOC and letter of subrogation. Order may be passed accordingly.
On the basis of the statement of the complainant, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party to pay an amount of Rs. 48,450/- as full and final settlement amount to the complainant, subject to submission of cancellation of RC, Form 29,30 & 35,
NOC and letter of subrogation within 60 days from the date of this order. File be consigned to the record room. Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
