The record is put up by a petition on behalf of the complainant.

The complainants namely Provat Kumar Modak and his wife Smt. Kalpana Modak have filed a petition along with Xerox copies of pass book issued by the Central Bank of India stating that during pendency of the case, the Consumer Dispute has been settled down out of the Commission and the OP on that basis has already paid the settlement amount to the complainants. For that, the complainants are not willing to proceed with the case further and pray for disposing of the case for non prosecution.

Heard the Ld. Advocate for the complainant. Perused the case record and said petition supported by verification.

Hence it is

Ordered

that this case be and the same is disposed of for non prosecution.

Let a copy of this order be given to the parties on free of cost.
