Shashi Bala Versus M/s. MVL Ltd. & others.

                   Ld. Counsel for the complainant made statement to the effect that due to technical defect in the present complaint, he withdraws the same as the cost of the plot in question is Rs.26,25,000/- and pecuniary jurisdiction of the same is before Hon’ble Haryana State Commission, Panchkula.  The Counsel for complainant has got permission to file a fresh complaint before Hon’ble Haryana State Commission, Panchkula and also requested for exemption of time spent before this forum and return of original documents. 

                Keeping in view the statement made by ld. Counsel for the complainant, the present complaint is dismissed as withdrawn.  However, the complainant is at liberty to file a fresh complaint before the Hon’ble Haryana State Commission, Panchkula, if so desired.  Exemption of time spent before this Forum is granted in terms of the judgment of the Hon’ble Supreme Court of India in the case titled “Luxmi Engineering Works versus PSG Industrial Institute  (1995) 3 SCC page 583”.   The original documents placed on the file be returned to the complainant after placing the photo-copy of the same on the file as per rules.  File be consigned to record room after due compliance.
