O.P/O.Ps : M/S Motobuzz Co. & another.
One Uttam Kumar Halder has filed the revision stating that he filed Complaint Case No. 102/2021 praying for compensation and direction upon the O.P. to provide one key and tool against the O.Ps. and this Commission passed the final order on 14.12.2021by allowing the complaint with a direction upon the O.Ps. to resolve the case dated 13.10.2018 pending before the KASBA ARTO in connection with vehicle with WB/06C/0997 by three months and to refund of Rs. 1,35,000/- to the complainant with simple interest @6% p.a. w.e.f. 14.05.2021 after taking delivery of the vehicle in question and other documents / materials received by the complainant at the time of purchase from the complainant by three months from the date of this order and to pay Rs. 5,000/- as litigation cost. That the revisionist prayed in the W/C in CC No. 107/2021 compensation cost of Rs. 4,50,000/- and litigation cost of Rs. 40,000/- and second key and tools.
We have heard the Revisionist. It is urged that order may be passed for delivery of a key and tools of the car and also prayed for compensation and litigation cost in terms of the prayer in the complaint.
This scope of review U/s 40 of the C.P. Act, 2019 is very limited. Section 40 runs thus: “The District Commission shall have the power to review any of the order passed by it if there is an error apparent on the face of the record, either of its own motion or on an application made by any of the parties within 30 days of such order.”
In the present revision, the revision petition was filed on 21.12.2021 i.e. within the statutory period of 30 days from the date of the final order. On going through the final order dated 14.12.2021 passed in CC No. 102/2021, we find that there is no error apparent on the fact of record. Hence, we are not inclined to allow the revision application. Accordingly, the revision application is dismissed.
