The case is taken up for admission hearing.

Perused. Considered the complaint application and photo copies of the documents annexed hereto.

Heard the Ld. Advocate for the complainant.

It appears from Annexue-A Page-19 (running page 18 to 21) that there was an Article of M.O.U. executed on 28/01/2021 between the complainant and the opposite parties and authenticated on 28.06.2021 by authorized Notary for development of the shali land mentioned in the schedule of the complainant for which the complainant has paid Rs.11,00,000/- (Rupees eleven lakh) only to the opposite parties. It further appears that on the same date i.e. on 28/06/2021 the complainant gave the same shali land to the opposite parties for a term of four (4) years on and from 28/01/2021 at a monthly rent of Rs.64,000/- (Rupees sixty four thousand) only.

Therefore, it is crystal clear that the said shali land is under the possession of the opposite parties.

It is apparent on the face of the record that the case has been filed matured.

In course of hearing Ld. Advocate for the complainant ‘Not Pressed’ the complaint application.

Hence, it is

O R D E R D

that the instant complaint case be and the same is dismissed in favour of the observation made above.
