Today the case was fixed for service of OP No.3 as well as for filing fresh address of OP No.4. However, parties entered into compromise. Representative of OP No.2 Sh. Shiv Raj has made a statement recorded separately that OPs are ready to replace the defective mobile of the complainant with upgrade model of 32 GB (HTC 828) subject to deposition of old mobile alongwith accessories within a period of 15 days. On the other hand, the complainant has also made a statement that he has heard and understood the above statement which is correct and in view of the same, he does not want to pursue his complaint. Both the parties shall be bound by their statements.
As per compromise, the OP No.2 is directed to replace the old mobile with new one as per their statement within a period of 15 days otherwise complainant shall be at liberty to invoke the jurisdiction of this Forum as per law. The present complaint stands partly allowed. Copies of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
