JUDGMENT
The facts of the complaint in brief is that, the complainant has purchased one Sony Xperia Mobile from O.p. No.1 with a consideration of Rs23,000/- on 06.12.2013 vide cash memo No.Nil dt.06.12.2013 but to the utter surprise the mobile set started giving trouble like hanging, heating, sometime display automatic white, camera not clear and set becoming heat when it use and the matter was informed to the O.p. No.1 and the set was duly sent to the O.p. No.3 for service but they have not given any service stating that it has inherent manufacturing defect in it and replied that the O.p. No.2 can replace the same and the complainant approached the O.p. NO.1 to replace the same and but it was not replaced. At last the complainant finding no other option approached this forum for relief and prayed to direct the O.Ps to refund the cost of the mobile i.e. Rs.23,000/- with compensation .Hence, this complaint.
On being noticed, the O.ps appeared through their advocate Sri K.N.Samantray, Advocate, Jeypore but did not file written version as such they were set exparte and in absence of any written version from the opposite party we proceeded the matter exparte and believed the allegations of the complainant and hence, we passed the order and dispose of the matter with the following directions.
ORDER
The opposite parties are directed to refund the cost of the handset i.e Rs.23,000/- and pay compensation of Rs.1000/- for mental agony undergone by the complainant and cost of Rs.500/- within one month from the date of receipt of this order, failing which the O.Ps are liable to pay interest @ 12% p.a. on the above awarded amount till the date of payment.
Pronounced in open forum today on this 12th day of June,2015 under the seal and signature of this forum.
A copy of this order be forwarded to the parties free of charge as per the statutory requirement.
