These are the complaints filed U/s. 12 of the Consumer Protection Act of 1986 by the respective complainants seeking direction against the same Opposite Party (herein after called as O.P) to execute the sale deeds and register the same in favour of the complainants in respect of the sites allotted in “Vajragiri Township” and to pay compensation of Rs.3,00,000/- for mental agony, inconvenience, hardship, difficulties etc., caused to each of these complainants on the allegations of deficiency in service.

 

2. Since OP is common in all these complaints, the questions involved and the relief’s claimed being similar, in order to avoid the repetition of facts and multiplicity of reasoning’s these complaints are stand disposed of by this common order.

 

3. The case of the complainant to be stated in brief is that:

 

The OP is engaged in the business of land development by forming residential layouts.  During 1995 OP gave wide publicity proclaiming that they are reputed developers and builders and about the launch of new township by name “Vajragiri Township” on Mysore Road located just 24 kms from Bangalore green belt.  Thus complainant being attracted by the said developments with an intention to purchase residential sites, became the members with OP by paying prescribed amount.  The parties entered into agreements of sale of the sites in “Vajragiri Township” and paid sale considerations in monthly installments.  Further OP has also collected development charges, stamp duty, registration charges, miscellaneous charges etc., from the complainants.  After the receipt of the amounts, OP has allotted sites, issued possession certificates to the complaints.

 

In complaint No.1620/2011 the complainant was allotted membership No.3026, scheme No.I.  He has paid the entire site value of Rs.48,000/- to the OP in monthly installments.  In all the complainant has paid the following sum to the OP

In complaint No.926/2012 One Sri.G.Puttaswamy was a member, he was allotted membership No.1838, scheme No.I.  He has paid the part of the site value of Rs.28,800/- to the OP in monthly instalments.  Thereafter on 03.06.2003 one Ramesh P.R made an application for transfer of membership in favour of the complainant after collecting the amount paid by him to the OP and accordingly OP has transferred the membership in favour of the complainant.  In all said Sri.Puttaswamy G and the complainant have paid the following sum to the OP.

In complaint No.2469/2012 the complainant with wife and his two children were allotted membership Nos.2023, 2024, 2025 and 2026.  They have paid the monthly installments regularly towards the site value.  On 01.07.2000 the complainant’s wife and children requested to OP to allot a bigger site measuring 4800 sq. feet in favour of the complainant instead of 4 sites each measuring 1200 sq. feet and OP agreed to the same.  The complainant was allotted site No.72, E-I Block, I Phase measuring 60’ x 80’.  In all the complainant has paid the following sum to the OP.

The complainant was allotted site No.345, G Block, I Phase, measuring East to West 40 feet and North to South 30 feet totally measuring 1200 sq. feet.

 

In complaint No.711/2015 the complainant was allotted membership No.7091, scheme No.2.  He has paid the entire site value and registration amount of Rs.4,32,275/- to the OP in monthly installments.  In all the complainant has paid the following sum to the OP.

The complainant was allotted site No.38, E-1 Block, I Phase, measuring East to West 60.5 feet and North to South 100 feet totally measuring 6050 sq. feet.

 

          The complainants even though paid the entire amount to the OP for purchase of their sites, OP never bothered to register the sites in favour of the complainants and on the contrary OP is procrastinating the issue on one or the other ground.  The complainant’s caused legal notice to OP calling upon them to execute the sale deeds in respect of the sites situated in Vajragiri Township.  OP has replied the legal notice by taking untenable stand.  Hence, these complaints.

 

          3. On appearance, OP filed version with similar contentions in these complaints.  It is contended that OP is a registered company under the Indian Companies Act, 1956 and the same was established for the purpose of developing lands for the formation of residential layouts with civic amenities and to allot the same to its members.  The OP in order to achieve its object had entered into an agreement and also the land owners had executed registered General Power of Attorney in favour of OP, agreeing to sell the various extent of lands in various survey numbers of Seshagirihalli and manchanayakanahalli of Bidadi Hobli, Ramanagaram Taluk Krishnarajapura and Hampapura Village, Kengeri Hobli, Bangalore South Taluk, Bangalore District.  The OP in order to form the residential layout was required to obtain the permission from various authorities, namely Deputy Commissioner Bangalore, Bangalore Metropolitan Region Development Authority (BMRDA) and Bangalore-Mysore Infrastructure Corridor Area Planning Authority (BMICAPA).  The OP applied for conversion of agricultural land into non-agricultural purposes to form the layout to the concerned Revenue Department.  The OP proposed to form the layout within the purview of Bangalore-Mysore Infrastructure Corridor Area Planning Authority (BMICAPA) and therefore the Revenue Department sought clarification/no objection from BMICAPA by its letter dated 18.07.2001.  However, BMICAPA had issued a letter dated 13.08.2001 to the Revenue Department to the effect that the land in question cannot be converted for non-agricultural purposes.  Under the above circumstances, the OP is not in a position to form the residential layout as proposed earlier.  When OP took up a project, there were no legal hurdles as such for the formation of the layout.  But due to the change in circumstances, OP is not in a position to complete the project as proposed.  Under these circumstances, OP is not in a position to complete the formation of the residential layout and to execute the sale deed pursuant to the agreement executed by the OP in favour of the complainants.  The cause of action for filing the complaints commences from the last day of payment of installment.  The complainants have not taken any steps to file the complaints for the alleged deficiency of service within two years from the last payment made by them.  Therefore, the complaints are barred by limitation and same are liable to be dismissed.  However it is submitted that OP acquired sufficient land in and around Seshagirihalli, Talaguppe, Manchanayakanahalli, Bannikuppe and Kurubarakarenahalli, Bidadi Hobli, Ramanagara Taluk, Hampapura and Krishnarajapura, Kengeri Hobli, Bangalore South Taluk.  OP allotted the sites in favour of some of the complainants in the land acquired but however some of the sites allotted in Sy No.21 of Krishnarajapura Village, Kengeri Hobli, Bangalore South Taluk.  Site No.93 in ‘E’ Block, in Sy. No.33 of Hampapura Village, Kengeri Hobli, Bangalore South Taluk, Bangalore.  OP purchased the land from one Sri.Marappa and Muniyappa and have executed the sale deed in favour of the OP.  Subsequently the same land was sold to third party i.e., Vijaya Bank.  Hence OP Company filed civil suit, the same is pending before Civil Court, Bangalore.  Under these circumstances OP cannot pay any compensation, interest or any damages.  OP always ready and willing to execute sale deed in favour of the complainants in terms of the allotment and OP informed the complainants to come forward to get the sale deed executed but they did not come forward so far.  Non-execution of the sale deed is not intentional, but because of the reasons that the complainants did not come forward to get the sale deed executed in their favour.  OP has not committed any breach of conditions of the agreement.  OP is not liable to pay any damages as claimed by the complainants.  OP has made arrangement to refund the advance amount received and it has also communicated to almost all the members to receive back their advance amount as the OP is not in a position to complete the project due to the aforesaid reasons.  The complainants instead of approaching the OP have approached this Forum by filing these complaints.  OP is ready and willing to refund the advance amount paid by the complainants.  The interest which the complainants are seeking cannot be granted for the reasons that this OP is invested the amount received from the complainants towards the land and the huge investment of OP is held up in civil litigations and acquisition proceedings and therefore OP is not liable to pay interest/damages/compensation as claimed by the complainants.  Hence, it is prayed to dismiss the complaint with exemplary costs.

 

4. On the rival contention of both the parties, the points that arise for our determination in these complaints are as under:

        5. To substantiate the allegations made in their complaints, each one the complainants have filed their affidavit evidence and produced some documents.  OP also tendered his evidence by way of affidavit in support of the averments made in the version and placed reliance on certain documents.  Heard the arguments advanced by both sides.

 

          6. Perused the allegations made in the complaints, version, documents produced by all the complainants as well as OP and other material placed on record.

 

7. Our answer to the above issues are as under:

It is not in dispute that, OP has floated a residential layout under the name and style “Vajragiri Township” Bangalore - Mysore state highway in the year 1995.  OP promised to form the layout consisting of residential sites of various dimensions.  OP also promised to provide all the basic amenities necessary for a residential layout.  OP also promised to complete the said project within 60 months.  Complainants attracted by the offer made by the OP thought of becoming members of the said scheme and got themselves enrolled.  OP provided the facility of payment of the sital value in monthly instalments.

The complainants claims that they opted to purchase the sites of their choice as mentioned in the chart and paid the entire sital value in instalments within 60 months.  It is further claimed that after completion of the said scheme, OP failed to register the sites in their favour.  OP has entered into an agreement to sell particular site, as noted above and in most of the cases issued possession certificate long back.  The complainants have produced documents to that effect.  OP has not at all disputed the fact that these complainants became the members of the scheme and have paid the entire sital value having entered into an agreement to sell a particular site and issuance of possession certificate, as well.  Therefore, we feel it unnecessary to discuss about the admitted facts.

We do not have reasons to disbelieve the affidavit evidence of complainants which are supported and corroborated by documents produced by each one them.  It is the case of OP that, due to legal hurdles, it is unable to complete the said project.  It is contended by OP that though they acquired certain quantity of land for the purpose of formation of the layout from the land owners and took agreements and GPA and paid huge amount, but unfortunately some of the land owners sold the said lands to third parties for higher rate.  Therefore, OP was compelled to file civil suits against the said vendors for the specific performance of the contract, in civil courts.  OP has given suit numbers and the law courts in which the proceedings are still pending and complainants did not dispute the same.

OP further contended that though they sought for the statutory permission and sanction from the competent authorities including Deputy Commissioner, Bangalore Rural and BMICAPA to accord sanction to convert the said agricultural land into non-agricultural purpose, but the same was refused.  It is further contended by the OP that, Government itself proposed to acquire the said survey numbers, which OP intended to purchase, for promoting industrial town specially in favour of KIADB.  It is also claimed by the OP that, Government proposed to acquire some of the said lands to promote their project ‘Ashraya Yojana’.  Gazette notification in that regard is issued.  OP produced the said documents.  In addition to that NICE Company also claimed their rights over certain survey numbers, intended to be purchased by OP.  OP has produced relevant documents to substantiate the same.

The complainants have not disputed or denied the said contention of the OP.  The project proposed by the OP extends to more than 650 acres of land.  There is a clause in the ‘agreement to sell’ that the vendor shall provide with good and marketable title to property free from all encumbrance, dispute etc.  However in view of changed circumstances referred to above, it appears to us that OP is unable to complete the said project and it is admitted by OP that it is not at all in a position to complete the said project.  There is an admission on the part of OP with regard to non completion of the layout, though for various reasons.  So this admission itself amounts to deficiency in service.  When OP has collected entire sital value from almost all the complainants for the formation of the layout and allotment of residential sites, now after lapse of 5 to 10 years if OP says that it is unable to complete the project because of certain unavoidable circumstances, hurdles itself is a glaring example of deficiency of service on his part.

Complainants contended that OP failed to seek permission for conversion of the said lands at the earliest.  Though certain lands were permitted to be converted from agricultural to non agricultural purpose, OP did not complete the project.  Complainants further contended that, OP having converted certain lands for non agricultural purpose sold the said lands for higher price to third parties thereby cheated them and practiced fraud upon them.  The learned advocate for OP submitted that they secured the sanction to convert agricultural land into non agricultural purpose in respect of 112 acres of land and the sites were formed in the said land, the layout was also approved and some of the members were also allotted sites.  He further submitted that since those lands were not in dispute, sale deeds also have been registered in favour of some of the members.  Complainants did not deny that some of the members are lucky enough to get the sites registered in their name since the sites carved out were not part of the lands in dispute.  OP contended that unfortunately the sites which are allotted to the present complainants fell within survey numbers which are subject matter of legal disputes referred to above.  The complainants have also not shown to this Forum that their sites are carved out of survey numbers which are not involved in legal disputes.  So in absence of such basic proof, we have no other go but to believe the submission of the OP that, these sites now allotted to the complainants forms part and parcel of survey numbers which are under dispute.  OP has also furnished the numbers of civil suits and the law courts in which the same are pending.  None of the complainants placed any material before us to substantiate their contention that, the OP is in position to execute sale deeds in respect of sites allotted to them and the sites are till today available for registration in their respective names.

 

          14. Though the complainants alleged that OP failed to keep up its promise as per the agreement to sell but none have approached the competent court by filing suit for specific performance and seek redressal.  The complainants have also not produced any material to show that OP has formed the said layout, carved out of the disputed survey numbers and it is an approved layout from the statutory authorities.  In absence of such proof the bare claim of the complainants to register the site cannot be considered.

 

          15. No doubt the complainants have invested their hard earned money to acquire certain site but they are unable to reap the fruits of their investment.  Naturally they must have suffered both mental agony and financial loss.  OP having retained the said amounts accrued the wrongful gain to itself thereby caused wrongful loss to the complainants.  When OP felt that, it is not in a position to complete the project came forward to refund the sital value with interest at Bank rate, but complainants refused to accept the said offer.  The complainants were more interested to acquire the site rather than take back the money paid by OP.

 

          16. No material has been placed on record to show that any sites are available at the disposal of OP to register the same in favour of complainants and the said sites are free from litigation, encumbrances.  In view of the litigation referred to above, it appears to us that, survey numbers out of which the sites of complainants are carved out are under litigation.  That is the reason OP failed to complete the project.  Though in the layout plan OP has shown the existence of the said sites, but unfortunately OP is unable to get the legal sanction from the statutory authorities.  That is why it made an offer to the complainants if they are ready to take the risk of legal hurdle even till today they are ready to execute the sale deed.

 

          17. In view of the facts and circumstances of the case, we are of the considered opinion that, in absence of proof of availability of said sites free from legal hurdles and those sites being at the disposal of the OP, we cannot direct the OP to execute the sale deed.  In our view the justice will be met by directing OP to refund the sital value with interest.  If the complainants had invested the said amount in some other project definitely they would have earned sizeable benefit and profit even they would have acquired certain site from the different promoters.  The complainants have been deprived of the same due to negligence and hostile attitude of the OP.  Under the circumstances though all the complainants have not sought for alternate relief of refund of advance amount, in our view, it is just and proper to provide the alternate relief.  As for as the claim of compensation made by each complainant, we proposed to award compensation taking into consideration the advance amount paid by each one of them and the hardship, inconvenience as well as mental agony undergone by them.

 

          18. In complaint No.926/2012 the complainant out of Rs.96,000/- to be paid towards value of the site, has paid only a sum of Rs.30,009/- including membership fee and transfer fee and failed to pay the remaining amount, in instalments as agreed.  Therefore, he is not entitled for any interest on the said amount.  However, he is entitled for adequate compensation for the reason that OP has retained the said amount illegally with them, even after completion of the scheme.

 

          19. Similarly complainant in complaint No.2458/2012 has paid total sum of Rs.74,200/- out of Rs.1,32,000/- agreed to be paid by her towards the value of the site.  No reasons have been assigned by her for her failure to pay the balance amount in instalments as per scheme.  Therefore, this complainant is also not entitled for interest on the said amount.  However, she is entitled for adequate compensation since OP has retained the said amount with them illegally even after completion of the scheme.

 

          20. In complaint No.2466/2012, the complainant has paid only a sum of Rs.67,400/- out of Rs.96,000/- towards value of the site.  Complainant failed to explain the reasons for his failure to pay the balance amount.  Therefore, he is not entitled for interest on the said amount.  However OP is liable to pay adequate compensation to the complainant for having retained the said amount with them illegally even after completion of the scheme.

          21. During the course of dictation, we noticed that, the documents pertaining to complainant Sri.Jayakumar S S/o V.C Subramani in complaint No.2455/2012 have been produced in complaint No.2457/2012 filed by Sri.Jayakumar P.R S/o P.Ramaiah.  The learned advocate for complainants needs to rectify the said mistake to avoid future complications.

 

22. In view of the discussions made in the above paragraphs, we are of the opinion that, the complainants are successful in proving deficiency of service on the part of OP.  In view of the reasons assigned by us in the above said paragraphs, we find that, the respective complainants are entitled for certain relief.  Accordingly point Nos.1 & 2 have been answered.

 

23. The order could not be passed within the stipulated time due to heavy pendency.

 

24. In the result, we proceed to pass the following:

OP in complaint No.1620/2011 is directed to refund advance amount of Rs.60,200/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

OP in complaint No.919/2012 is directed to refund advance amount of Rs.2,59,266/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.1,00,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.920/2012 is directed to refund advance amount of Rs.54,200/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.921/2012 is directed to refund advance amount of Rs.48,200/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.922/2012 is directed to refund advance amount of Rs.78,200/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.923/2012 is directed to refund advance amount of Rs.86,850/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

OP in complaint No.927/2012 is directed to refund advance amount of Rs.87,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.928/2012 is directed to refund advance amount of Rs.1,11,200/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.1,00,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.929/2012 is directed to refund advance amount of Rs.1,79,020/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.1,00,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.930/2012 is directed to refund advance amount of Rs.54,200/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.931/2012 is directed to refund advance amount of Rs.78,200/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.932/2012 is directed to refund advance amount of Rs.49,260/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.933/2012 is directed to refund advance amount of Rs.65,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.934/2012 is directed to refund advance amount of Rs.87,250/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.935/2012 is directed to refund advance amount of Rs.1,15,400/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.1,00,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.936/2012 is directed to refund advance amount of Rs.66,284/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.937/2012 is directed to refund advance amount of Rs.1,15,400/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.1,00,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.938/2012 is directed to refund advance amount of Rs.48,200/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.

 

OP in complaint No.939/2012 is directed to refund advance amount of Rs.75,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP is directed to pay compensation of Rs.75,000/- to the complainant towards deficiency of service resulting in hardship, inconvenience and mental agony together with litigation cost of Rs.4,000/-.
