AWARD

1.        Vide his separate statement already made on 09.12.2022, Sh.Nitesh Singhi, Counsel for OPs has stated that the parties have settled the dispute and as per settlement, the OPs have agreed to pay principal amount of Rs.11,10,000/- to the complainant alongwith interest @ 7.5% p.a. from the respective dates of payment. Further stated that three post dated cheques of Rs.3,70,000/- each towards principal amount (cheque No.106984 dated 31.12.2022, cheque No.106983 dated 31.03.2023 and cheque No.106981 dated 30.06.2023 drawn on Bank of Maharashtra in favour of complainant) has been handed over to the complainant. Counsel for OPs has further stated that the above said interest amount i.e. @ 7.5% p.a. shall also be paid with each cheque amount respectively in the month of December 2022, in the month of March 2023 and in the month of June 2023 and in case of any default in payment, the entire amount shall be paid alongwith interest @ 12% p.a. from the respective dates of payment made by the complainant. Counsel for OPs has further stated that the complainant will supply the account details to the OPs for the purpose of payment of pending interest amount and on payment of the entire amount by the OPs, the complainant shall not make any claim over the plot/property in question and will surrender all the documents executed by the OPs in favour of complainant. Vide separate statement already made on 09.12.2022, Sh.Hoshiar Chand, Counsel for Complainant alongwith complainant in person have admitted the statement of counsel for OPs and prayed that the complaint be disposed off in terms of aforesaid settlement in Grahak Madhyastata Samadhan on 16.12.2022. Photocopy of the cheques have been taken on record.

2.        In view of the aforesaid statements of the parties, the complaint is disposed off as settled. The statements made by the parties shall be deemed to be a part of this order and the parties shall be bound by the same. The award is accordingly passed.

3.        Certified copies of this order be sent to the parties free of cost. The file be consigned.
