CONSUMER COMPLAINT NO. 268  OF  2021

AWARD

1.        Vide his separate statement already made on 09.12.2022, Sh.Nitesh Singhi, Counsel for OPs has stated that the parties have settled the dispute and as per settlement, the OPs have agreed to pay principal amount of Rs.29,25,000/- to the complainants alongwith interest @ 7.5% p.a. from the respective dates of payment. Further stated that six post dated cheques of Rs.4,87,500/- each towards principal amount in favour of complainant No.2 all drawn on Bank of Maharashtra have been handed over to complainant No.1. Counsel for OPs has further stated that it is further settled that the above said interest amount i.e. @ 7.5% p.a. shall also be paid with each cheque amount respectively in the month of December 2022, in the month of March 2023 and in the month of June 2023 and in case of any default in payment, the entire amount shall be paid alongwith interest @ 12% p.a. from the respective dates of payment made by the complainants. Counsel for OPs has further stated that the complainants shall supply the account details to the OPs for the purpose of payment of pending interest amount and on payment of the entire amount by the OPs, the complainants shall not make any claim over the plot/property in question and will surrender all the documents executed by the OPs in favour of complainants. Vide separate statement already made on 09.12.2022, Sh.Hoshiar Chand, Counsel for Complainants alongwith Complainant No.1 in person have admitted the statement of counsel for OPs and prayed that the complaint be disposed off in terms of aforesaid settlement in Grahak Madhyastata Samadhan on 16.12.2022.

2.        Today, in continuation of the statement dated 09.12.2022, counsel for complainants has stated that due to technical defect in the cheques already given by counsel for the OPs on the last date of hearing i.e. 09.12.2022, the same have been replaced by OPs with new cheques, the details of which have been given in the statement recorded today separately. Counsel for OPs has also appended his signatures on the bottom of statement of counsel for complainants. Photocopy of the cheques have been taken on record.

3.        In view of the aforesaid statements of the parties, the complaint is disposed off as settled. The statements dated 09.12.2022 and 16.12.2022 made by the parties shall be deemed to be a part of this order and the parties shall be bound by the same. The award is accordingly passed.

4.        Certified copies of this order be sent to the parties free of cost. The file be consigned.
