CONSUMER COMPLAINT NO. 258  OF  2021

AWARD

1.   Vide his separate statement already made on 14.12.2022, Sh.Nitesh Singhi, Counsel for OPs has stated that the parties have settled the dispute and as per settlement, the OPs have agreed to pay an amount of Rs.13,31,000/- to the complainant, which includes principal amount, compensation and costs of litigation. Further stated that the first installment of Rs.3,55,500/- shall be paid on or before 15.01.2023 regarding which post dated cheque No.106980, dated 15.01.2023 for Rs.3,55,500/- has been handed over to the complainant today; the second installment of Rs.3,55,500/- shall be paid on or before 31.03.2023 regarding which post dated cheque No.106979, dated 31.03.2023 for Rs.3,55,500/- has been handed over to the complainant today and the third installment of remaining amount of Rs.6,20,000/- shall be paid to the complainant in his saving bank account No.004301026605 of ICICI Bank Ltd. Sector 11, Panchkula IFSC Code : ICIC0000043 straightway or through cheque/draft on or before 07.04.2023. Further stated that in case of any default in payment, the defaulted amount shall be paid alongwith interest @ 10% p.a. from the date of filing of the present consumer complaint i.e. 20.04.2021. Further stated that on payment of the entire amount by the OPs, the complainant shall not make any claim over the plot/property in question and will surrender all the documents executed by the OPs in favour of complainant. Vide his separate statement, Sh.Ashu Deep Saddi, Complainant in person has admitted the aforesaid statement of counsel for OPs and prayed that the complaint be disposed off in terms of aforesaid settlement in Upbhokta Lok Adalat.

2.        In view of the aforesaid statements of the parties, the complaint is disposed off as settled. The statements made by the parties shall be deemed to be a part of this award and the parties shall be bound by the same. The award is accordingly passed.

3.        Certified copies of this order be sent to the parties free of cost. The file be consigned.
