AWARD

1.   Vide his separate statement recorded on 05.01.2024, Sh.Nitesh Singhi, Counsel for OPs has stated that the matter has been settled between the parties amicably and as per settlement, the OPs shall pay lump sum amount of Rs.15,31,000/- to the complainant in installments towards full and final settlement, out of which first installment of Rs.2,50,000/- will be paid on or before 31.01.2024, second installment of Rs.2,50,000/- will be paid on or before 29.02.2024, third installment of Rs.5,00,000/- will be paid on or before 31.05.2024 and last & final settlement of Rs.5,31,000/- will be paid on or before 30.06.2024. It has been further stated by counsel for OPs that the aforesaid amount of installment shall be transferred in the bank account of the complainant straightway through electronic mode. It has been further stated by counsel for OPs that on the payment of entire amount, the complainant shall not have any right, title or interest in the property in question and the documents in original, if any, with regard to property in question will be returned by the complainant to the OPs at the time of last payment. It has been further stated by counsel for OPs that in case of any default in payment, the defaulted amount shall be paid alongwith interest @ 9% p.a. from the date of default. Vide his separate statement recorded on 05.01.2024, Sh.Davinder Pal Singh, Authorized Representative of Complainant has admitted the aforesaid statement of counsel for OPs and prayed that the complaint be disposed of in terms of aforesaid settlement in Upbhokta Lok Adalat. He has also prayed that the aforesaid amounts may kindly be transferred straightway into the following bank account of the complainant:-

2.   In view of the statements made by the counsel for OPs & authorized representative of complainant and in terms of the settlement, the complaint stands disposed of by passing the following order:-

1. OPs shall pay lump sum amount of Rs.15,31,000/- to the complainant in installments towards full and final settlement, out of which first installment of Rs.2,50,000/- will be paid on or before 31.01.2024, second installment of Rs.2,50,000/- will be paid on or before 29.02.2024, third installment of Rs.5,00,000/- will be paid on or before 31.05.2024 and last & final settlement of Rs.5,31,000/- will be paid on or before 30.06.2024 and the aforesaid amounts shall be transferred in the aforesaid bank account of the complainant straightway through electronic mode.
2. On the payment of entire amount, the complainant shall not have any right, title or interest in the property in question and the documents in original, if any, with regard to property in question will be returned by the complainant to the OPs at the time of last payment.
3. In case of any default in payment, the defaulted amount shall be paid by OPs alongwith interest @ 9% p.a. from the date of default.
4. No TDS shall be deducted by the OPs from the aforesaid amount.
